  Abstract:  Les parents par le sang ont progressivement perdu du terrain devant le conjoint survivant. Les reformes dans les différents pays européens lui ont octroyé une position patrimoniale de plus en plus solide. Mais, est-ce que ça suffit ? Est-ce que les mesures prises dans son avantage ont réussi lui donner satisfaction ? La réponse sera donnée en étudiant l’exemple paradigmatique de la législation roumaine en matière, en faisant la comparaison avec ses sources et ses modèles.
