Le testament olographe et la portée du formalisme: étude appliquée au problème de la date. Le nouveau code civil roumain n’a apporté aucune modification au texte régissant le testament olographe dans le code de 1865. Emprunté au code napoléonien (art. 970), il reste en tant que tel en dépit de la jurisprudence tumultueuse générée par sa datation. Notre analyse s’interroge sur la signification et sur l’opportunité de son maintien en tant que tel.La jurisprudence roumaine a suivi au début la rigidité des tribunaux français dans l’observation des exigences formelles imposées par l’art. 970 (art. 859 roumain). Sous l’influence des assouplissements successifs apportés en France après une décision prononcée par la Cassation civile en 1855, elle s’est prise après la moitié du XXe siècle même la liberté d’une position plus courageuse. Il sera utile de comparer cette orientation du juge roumain avec les revirements provoqués en France par les arrêts Payan et Garon et avec la jurisprudence québécoise sur le testament informatique.
