  Abstract:  L’action en justice, est-elle un veritable act susceptible d’interrompre la prescription? En examinant les dispositions légales concernant la prescription, l’auteur observe que, en dépit des dispositions légales, la demande en justice ne produit pas les effets spécifiques à l’interromption du droit à l’action. En effet, la demande en justice, même admise par le tribunal, n’efface pas la prescription en cours et ne déclanche une nouvelle prescription du droit à l’action. L’auteur soutien toutefois le caractère interromptif de la prescription acquisitive.
