This study puts forward an analysis of the legal requirements concerning the form of a donation contract, while also aiming to highlight the correlation between the legal provisions of the new Civil Code of Romania and its relevant doctrine, on the one hand, and their French counterparts, on the other hand. For this purpose, the paper is divided into five main sections, encompassing some preliminary considerations, followed by the requirements of form, including an in-depth discussion on the principle of solemnity and its exceptions, the formation of the contract, the newly-introduced provisions with respect to the promise of a donation, while ending in some short conclusions.
