  Abstract:  The study tries to present a critical perspective over the new constitutional stipulations regarding the protection of the parliamentary mandate. Generally, this kind of protection includes legal irresponsibility over votes and political opinions and also, the inviolability of the person who obtain a parliamentary seat in order to insure his independence. Comparing to the old constitutional stipulations, the new formula is restraining parliamentary inviolability, which can imply serious consequences over democratic evolution of Romanian political system, under conditions that there remain questions regarding the independence of the Justice.
