  Abstract:  In our paper we try to analyze the structure of the identification elements of the trade companies in Romania. From the very beginning we tried to make a difference between the important elements such as the firm and the commercial sign and the elements that can help us to identify specific trade companies. We focused our analysis on specific topics such as : the social capital, Personal Identification Number. In the European Context we put in discussion the nationality of the trade companies in the new European dimension. We pointed out the difference between the concept of “firm” and the “trade companies”. The principles of the firm law were also analyzed in our research and we offered a comparative perspective of the Romanian law with the German law.
