  Abstract:  The following notes were inspired to me by the diversity of solutions offered by the jurisprudence for a matter of permanent actuality. Analyzing some of those solutions, we have endeavored to argument the opinion according to which, in the case of the spouses’ marital community termination, the spouse who is not a partner is entitled to a quota of the monetary rights afferent to the shares owned by the other spouse, if the contribution of the latter falls under the legal status of a marital community item.
