  Abstract:  L’exercice de la compétence communautaire en droit international privé apporte parfois des bouleversements sérieux des méthodes et solutions traditionnelles de cette matière. Une illustration en est offerte à travers la consécration, par le Règlement Rome I, du contrat international intracommunautaire, à propos duquel l’autonomie de la volonté des parties est sévèrement encadrée au profit du droit impératif de source communautaire. Notre étude tentera de montrer que si cette démarche est acceptable et légitime dans un ordre juridique intégré, entièrement harmonisé, les réalités législatives existantes aujourd’hui en Europe rendent la solution complexe et assez peu satisfaisante.
