  Abstract:  Avant d’aborder le thème proposé il faut préciser qu’il ne s’agit pas d’une constitution au sens formel, c’est-à-dire d’un document qui soit adopté par une assemblée constituante composée de représentants des peuples des Etats membres, mais, comme le nom aussi le montre, d’un traité; bien sûr, ce traité a été adopté selon la procédure prévue par le droit communautaire pour la révision des traités constitutifs (aspect que nous n’allons pas détailler ici), procédure qui implique également les institutions des Etats et celles des Communautés et de l’Union, c’est pourquoi nous n’avons pas intégralement à faire à un document de droit international. L’appellation utilisée réflète toutefois la structure d’une constitution, ce qui représente le mérite de ce nouveau traité.
