  Abstract:  Înainte de a încerca sã prezentăm lucrarea de faţă care, de la prima şi până la ultima pagină, ridică probleme legate de practica Curţii Constituţionale, de la înfiinţarea ei şi până în prezent, ne referim la opinia prof. univ. dr. Nicolae Popa, Preşedintele Curţii Constituţionale, exprimată într-un interviu public în „Palatul de Justiţie“ nr. 5/2002, p. 3, în care se arată: „Iată, acum, a venit momentul să ne reconsiderăm noi, teoreticienii, poziţia faţă de anumite aprecieri legate de sistemul izvoarelor dreptului. Într-adevăr, deciziile Curţii Constituţionale au valoare de precedent şi ele pot fi evocate ca precedente.
