  Abstract:  Se va anula ca nelegală, în raport cu prevederile art. 130 al.1 lit.c şi d Codul muncii, dispoziţia de desfacere unilaterală a contractului de muncă şi se va dispune reintegrarea contestatoarei pe postul anterior deţinut şi obligarea intimatei la plata drepturilor băneşti cuvenite contestatoarei, de vreme ce unitatea nu a probat că i-ar fi comunicat decizia şi nici că aceasta ar fi luat-o la cunoştinţă în vreun alt mod, de vreme ce nu a probat nici că are posibilitatea de a asigura pe plan local cadrele necesare şi nu a verificat dacă nu cumva contestatoarea acceptă să o urmeze la noul sediu. În plus,nu s-a solicitat nici sprijinul organului ierarhic superior şi al organului de repartizare a forţei de muncă pentru oferirea unui alt loc de muncă.
