  Abstract:  Prin sentinţa civilă nr.620/2001 a Tribunalului Arad – Secþia Comercială şi de Contencios Administrativ, în cadrul procedurii falimentului deschisă împotriva debitoarei SC Prodex SRL Arad, judecătorul sindic, constatând, la solicitarea lichidatorului, că valoarea bunurilor din averea debitoarei este mai mică decât valoarea creanţelor statului, a dispus aplicarea art.109 din Legea nr.64/1995 republicată, respectiv autorizarea statului de a-şi executa creanţele în baza OG nr.11/1996, închiderea procedurii reglementate de Legea 64/1995 şi descărcarea lichidatorului de îndatoririle şi responsabilităţile stabilite conform acestei proceduri.
