Struktur und Bedeutung der römischen Traditio. Die römische Traditio war ein formloses Übereignungsgeschäft. Sie bestand aus zwei Elementen: eine körperliche Übergabe und eine iusta causa traditionis. Der Begriff der iusta causa traditionis war vieldeutig und ließ unterschiedliche Interpretationen zu. Nachdem die mancipatio und die in iure cessio, von Iustinian abgeschafft wurden blieb nur noch die Traditio als Modell für die moderne Kodification des Eigentumserwerbs. Während die Ausdehnung der Traditionssurrogate wie die symbolische Übergabe, die Übergabe kurzer Hand und das Besitzkonstitut im französischen Recht schließlich zur Entbehrlichkeit der Traditio für den Eigentumserwerb führte, ging das deutsche Recht in eine ganz andere Richtung indem die Traditio als ein dingliches Rechtsgeschäft ausgestaltet wurde.
