Article:   INTERNATIONAL LAW AND THE RIGHT TO ANTICIPATORY SELF-DEFENCE. IMMINENT THREAT VERSUS POTENTIAL THREAT.

Authors:  KINGA TIBORI SZABO.

Abstract:  The present article discusses the recent developments in the interpretation of the international customary law of anticipatory self-defence. The classic formula of imminent threat is compared with the new, US-launched doctrine of potential threat. The comparison is built upon the parallel analysis of the specific elements of these theories and provides an assessment as to the necessity of such a new interpretation of the classic customary rule.
