  Abstract:  Din interpretarea art. 55 al Regulamentului din 1950 privind administrarea cimitirelor şi crematoriilor – în vigoare la data întocmirii testamentelor litigioase, – se desprinde concluzia restrângerii posibilităţii de transmitere a folosinţei locurilor de veci, în funcţie de natura gratuită a actului de transmisiune şi gradul de rudenie dintre dispunător şi dobânditor. Numai în aceste condiţii transmiterea locului de înhumare apărea ca având loc în interesul membrilor aceleiaşi familii şi ca nefiind generată de interese materiale, incompatibile cu aspectul moral ce urma să o justifice.
