  Abstract:  În decursul celor peste 40 de ani (1959 – 1998 ) de activitate s-au conturat câteva orientări ale jurisprudenţei elaborate de Curte. 1.1. Tendinţa spre stabilitate şi prudenţă s-a afirmat substanţial, fiind atestată de unele caractere marcante ale jurisprudenţei Curţii. a. Primul este afirmarea “caracterului subsidiar” al mecanismului european de control, care nu înlocuieşte şi nici nu anihilează dreptul intern, acesta fiind principalul instrument de protecţie a drepturilor şi libertăţilor fundamentale, ci, doar, le completeză, la nevoie, ori îi remediază deficienţele.
