  Abstract:  The Ethical Approach of the Infanticide – Accused Mothers in the Medico-Legal Psychiateric Expertise. The issues wich are raised in forensic psychiatric expertises of mothers accused of infanticide are the presence or the absence of discernment in the moment of committing the infanticid. The expert must keep a balanced attitude between empathy to the mother and objectivity in front of the infanticid. The absence of discernment of these women is caused in most of cases by psychiatric disorders related to pregnancy, and these diseases should be diagnosed correctly and eliminate all doubts. Another issue during the forensic psychiatric is the simulant behaviour of the pacient.
